Services

TRiiBE Creative provides strategic, creative and digital business services, including branding and graphic design, website and eCommerce development, marketing and content support, CRM and systems setup, automation and integrations, AI-assisted business solutions, consulting and strategy, training, digital products, templates and related services.

The exact inclusions for each engagement will be set out in the applicable proposal, quote, package description or scope of work.

Where there is any inconsistency between these Terms and a signed project-specific agreement, the project-specific agreement will apply to the extent of that inconsistency.

Quotes, Proposals and Scope

Quotes and proposals are valid for 30 days unless otherwise stated.

Our services are limited to the inclusions described in the agreed scope.

Requests outside the agreed scope may include additional pages, functions, integrations, revisions, meetings, content, design concepts, technical work or consulting time. Additional work may be quoted separately or charged at our current hourly rate where agreed.

We may decline requested variations where they substantially change the original project, fall outside our expertise or cannot reasonably be accommodated within the existing project schedule.

Deposits and Payment

A deposit or initial payment may be required before work begins. The amount and payment schedule will be specified in the relevant proposal or invoice.

Deposits reserve project capacity and contribute toward planning, administration and commencement of work.

Unless otherwise stated, invoices are payable within the timeframe shown on the invoice.

Final payment must be received before final deliverables, website ownership, source files where included, account transfers or other final handover items are released.

Where payments are overdue, TRiiBE Creative may reasonably pause work, withhold incomplete deliverables or postpone launch or handover until the account is brought up to date.

Late-payment fees may apply where they are disclosed on the applicable invoice, proposal or agreement and are permitted by law.

Nothing in this clause limits any rights or remedies available under Australian Consumer Law.

Project Timelines and Client Responsibilities

Project timelines depend on timely cooperation from both parties.

Clients are responsible for providing required information, copy, images, brand assets, approvals, account access, logins and feedback within agreed timeframes.

Clients must ensure information and materials supplied to TRiiBE Creative are accurate, lawful and appropriately licensed.

Where required material or feedback is delayed, project milestones and completion dates may be moved accordingly.

If a project receives no meaningful response from the client for 30 days, TRiiBE Creative may place the project on hold.

If a project remains inactive for 60 days or more, we may close the project and require a revised timeline, restart fee or new quote before work resumes.

TRiiBE Creative is not responsible for delays caused by the client or by third-party platforms, providers or suppliers outside our reasonable control.

 Revisions and Approval

The number of included revision rounds will be stated in the relevant project scope.

A revision means an adjustment to an agreed concept or deliverable. A change in overall direction, significant redesign, new functionality or work outside the original brief may be treated as additional scope.

Clients are responsible for reviewing proofs, designs, websites, copy and deliverables carefully before approval.

Once an item is approved, subsequent amendments may incur additional fees.

Consultations and Appointments

Appointments, strategy sessions, training sessions and consulting calls are reserved specifically for the client.

At least 24 hours’ notice is required to reschedule unless otherwise agreed.

Late cancellations, missed appointments or substantial lateness may result in the session being forfeited or charged in full.

Where a meeting extends beyond the booked time, additional consulting fees may apply where agreed.

Training or implementation sessions may be recorded for the client’s internal reference where appropriate. Clients may request that a session not be recorded.

Intellectual Property

TRiiBE Creative retains ownership of preliminary concepts, drafts, working files, unused designs, methodologies, systems, frameworks and proprietary materials unless otherwise agreed in writing.

Once all amounts relating to the relevant project have been paid, the client receives ownership or agreed usage rights to the final approved deliverables specifically included in their project scope.

Editable or source files are supplied only where explicitly included.

Third-party fonts, photographs, templates, software, code, plugins, stock assets and other licensed materials remain subject to their respective licence terms.

TRiiBE Creative retains the right to display completed work in our portfolio, website, social media, award submissions, case studies and promotional materials unless confidentiality has been agreed in writing before publication.

Client-Supplied Content

The client warrants that any content, trademarks, images, copy, data, photographs, video, fonts or other materials supplied to TRiiBE Creative are owned by the client or may lawfully be used for the project.

The client is responsible for the accuracy, legality and regulatory compliance of its business claims, offers, pricing, policies and content.

To the extent permitted by law, the client is responsible for claims arising from materials or instructions supplied by the client.

Websites and Technical Services

TRiiBE Creative will take reasonable care to deliver websites, systems and integrations that operate substantially as agreed at the time of handover.

Website and software performance may be affected by hosting, platform updates, plugins, browsers, third-party APIs, integrations, external software and other matters outside our control.

Unless a maintenance or support plan has been purchased, ongoing software updates, backups, security, domain renewals, subscriptions, app fees, hosting and maintenance become the client’s responsibility after handover.

TRiiBE Creative does not guarantee uninterrupted availability, search-engine ranking, specific traffic levels or commercial results.

 Third-Party Platforms and Software

Our projects may use services such as Wix, Shopify, WordPress, Dubsado, Canva, email-marketing platforms, automation platforms, payment gateways, hosting services, AI providers and other software.

Those platforms are operated by independent third parties.

Clients are responsible for ongoing third-party subscriptions, transaction fees, licence fees and usage costs unless expressly included in our proposal.

Third parties may change their pricing, functionality, terms, APIs or product availability at any time.

TRiiBE Creative is not responsible for third-party outages, closures, feature changes or other matters outside our reasonable control.

AI-Assisted Services

TRiiBE Creative may use artificial-intelligence tools as part of research, ideation, content development, automation, workflow design, visual exploration or other project processes.

AI-assisted outputs are reviewed and refined where appropriate, but AI-generated material may contain inaccuracies or require human verification.

Clients remain responsible for final approval of factual, legal, financial, medical, regulatory or industry-specific information used in their business.

We do not guarantee that third-party AI tools will remain available or produce identical results over time.

Digital Products, Templates and Courses

Digital products, downloads, templates, resources and courses are supplied under a personal or business-use licence unless otherwise stated.

Unless expressly permitted, purchasers must not resell, redistribute, share, reproduce for resale, sublicense or represent TRiiBE Creative materials as their own original product.

Access credentials must not be shared with unauthorised users.

Because digital products are supplied electronically, refunds for change of mind may not be available once access or download has been provided, subject always to rights that cannot be excluded under Australian Consumer Law.

Cancellations and Project Termination

Either party may request cancellation of a project in writing.

Where a client cancels after work has commenced, the client must pay for work reasonably performed, approved third-party costs incurred and any other amounts payable under the agreed project terms.

Any unused portion of payments will be handled in accordance with the applicable agreement and Australian Consumer Law.

TRiiBE Creative may terminate or suspend an engagement where there is persistent non-payment, abusive or inappropriate conduct, repeated failure to provide required information, unlawful instructions or another material breach of the agreement.

Consumer Guarantees

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Where Australian Consumer Law applies, services may be subject to guarantees including that they are provided with due care and skill, are fit for an agreed purpose in applicable circumstances, and are supplied within a reasonable time where no timeframe has been agreed.

Limitation of Liability

To the maximum extent permitted by law, TRiiBE Creative is not responsible for indirect or consequential loss arising from circumstances outside our reasonable control, including third-party outages, platform changes, external software failures or client modifications made after handover.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including rights under Australian Consumer Law.

Where liability can lawfully be limited, our liability will be limited to the extent permitted by applicable law.

 Confidentiality

Both parties must keep confidential any non-public business, commercial, financial, technical or project information received from the other party.

This obligation does not apply to information that is publicly available, independently developed, already lawfully known, authorised for disclosure or required to be disclosed by law.

Privacy and Data

Personal information will be handled in accordance with TRiiBE Creative’s Privacy Policy and applicable privacy laws.

Clients must ensure they have appropriate authority to provide us with personal information, customer data or access to business systems.

Where third-party software is used, information may also be processed in accordance with that provider’s privacy terms.

Subcontractors

TRiiBE Creative may engage suitably qualified contractors, designers, developers, consultants or other specialists to assist in delivering services.

TRiiBE Creative remains responsible for managing the engagement and overall project delivery.

Force Majeure

Neither party will be responsible for failure or delay caused by events outside their reasonable control, including severe illness, natural disaster, telecommunications failure, widespread technical outage, industrial disruption or government action.

The affected party must take reasonable steps to minimise the impact of the event.

Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve the issue in good faith through written communication and reasonable discussion.

If the matter cannot be resolved directly, the parties may agree to mediation or another appropriate dispute-resolution process before commencing court proceedings, except where urgent relief is required.

Changes to These Terms

TRiiBE Creative may update these Terms from time to time.

Changes will apply to future purchases and engagements from the date the updated Terms are published or otherwise communicated. Existing signed agreements will continue to be governed by the version or terms applicable to that engagement unless the parties agree otherwise in writing.

Governing Law

These Terms are governed by the laws of Queensland, Australia, unless another law must apply.

The parties submit to the jurisdiction of the courts and tribunals of Queensland and any courts entitled to hear appeals from them, subject to any rights that cannot lawfully be excluded.
